立法院三讀通過會計法修正案，擴大特別費除罪化範圍，但不包括總統的國務機要費。民進黨立院黨團總召柯建銘說，「陳水扁是最後的歷史共業」，民進黨團會持續進行朝野溝通、推動修法，將國務機要費除罪化。
