立委提食管法修正 增列危險犯加重刑罰

食安問題頻傳，立委管碧玲提出「食品衛生管理法」修正案，不只加重對違法業者刑罰，遏止廠商「罰小錢賺大錢」的歪風，更提出處罰對象除了「行為犯」、「結果犯」外，增加對「危險犯」的刑罰。

『所以整個修法除了相關罰則應該要加重之外，也加入「危險犯」才能夠真正遏止這種黑心的行為，那再加上強制賠償、強制責任的一個觀念。那這種所謂的「危險犯」我們在非常多法律裡面都有，他不是一個不確定法律概念，他是一個我們司法體系可以經過驗證去證明你是不是有「之虞」的一種「危險犯」的犯行型態。所謂有受重大損害之虞、各款情形之虞、安全之虞、傳染之虞等等，我覺得食安、食管法如果沒有引進「危險犯」的概念的話，他永遠都會陷在只能輕判，因為你沒辦法證明你實際上是受了什麼健康傷害。』
