趕不上公車打壞照後鏡　司機打老翁均判刑

【張欽／台北報導】游姓公車司機今年5月底駕駛大都會262號公車，行經北市中華路、成都路口公車站牌載客起步後，來不及上車的75歲陶姓老翁向游揮手表示要上車，但游未理繼續開車，陶男不滿憤而拍掉公車右前方照後鏡，游下車推倒陶翁，致陶手腕、臀部受傷，陶、游互控傷害、毀損。
 
台北地院根據公車行車記錄器畫面，認定2人犯行，依毀損罪判陶翁罰金8千元，得易服勞役1天折抵1千元，另依傷害罪判游男拘役20天，得易科罰金2萬元，全案可再上訴。

開庭時，陶翁雖承認碰落公車照後鏡但否認毀損，他辯稱是攔車，不小心碰到，而游男雖承認推倒陶翁但否認傷害，辯稱是陶翁先伸手捶他左胸才推他，屬正當防衛。
