軍審法釋憲洪家批 國防部：依法行政

已故下士洪仲丘家屬今天(21日)舉行記者會批評「軍法復辟，包藏私心」。國防部今天(21日)表示，立法院今年8月6日已經三讀通過軍事審判法部分條文修正案，國防部依法行政及配合政策的立場，未曾改變。

國防部指出，修法內容於8月15日施行後，國防部配合第一階段生效日移交相關軍法案件，由司法機關偵查、審理，都已順利完成；其他軍法案件將於明年1月13日第二階段生效日全數移交。

國防部強調，有關最高軍事法院及北部地方軍事法院審理的個案，對於應適用的法律，認為有牴觸憲法的疑義，所以依職權聲請司法院釋憲，這在司法機關是常見現象。國防部也說，司法院接收釋憲案後，至今尚未做出解釋。
