行政院前秘書長林益世涉貪案，台北地方法院3個法官認定他收錢、關說，但非「職務行為，並無實質影響力」，不構成貪污，上周將他輕判7年4個月，被全民罵翻。

據最新一期《壹週刊》報導，目前最高法院遲遲未對此貪污收賄訂出統一判例，同樣案情，有的被判貪污，有的卻無罪，氣得跳腳的特偵組，在台灣找不到上訴理由，只好決定向美國取經，提出索賄行徑和林益世幾乎相同的一位美國眾議員，被以貪污重判13年的案例，拿來當作上訴基礎，本周將正式提起上訴。
