行政院前院長謝長廷上午針對軍事審判法表示，依憲法的精神，憲法要保障人權、司法獨立。司法獨立的意義就是不受政治或上級的干涉，但軍事審判沒有辦法達到這樣的目的，是違反憲法的精神，他支持民進黨團這次修法的版本，希望能藉由這次社會能量的匯集及黨團的努力下，看到修法的成果。
