打行政官司爭免關 顏清標敗訴

（中央社記者黃意涵台北3日電）前立委顏清標因貪污案件入監服刑，他認為前案刑期經假釋、保護管束期滿後，應不需再服刑，提起行政訴訟；今天遭法院駁回。

判決指出，顏清標涉犯頂替罪、違反槍砲彈藥刀械管制條例罪及貪污罪等3罪，應執行有期徒刑7年；前兩罪被判決應執行有期徒刑3年9月後，顏清標入監服刑，並已於民國98年5月14日假釋出獄，假釋期間付保護管束至100年7月10日期滿。

顏清標今年2月19日又入監，需再服刑2年10月24日才能假釋。顏清標質疑刑期計算有誤，提起訴願遭不受理後，提起行政訴訟。

顏清標去年12月間，具刑事聲請狀致法務部矯正署等主張，法務部矯正署應依受刑人最有利的舊法核算，假釋條件也應參考從新從輕原則，矯正署應重核他應否再入監執行多久的殘餘刑期。

法務部回函，依台灣高等法院檢察署「刑罰執行手冊」規範，不論假釋期滿與否，應與前罪定刑後，由執行檢察官逕行換發執行指揮書，送交監獄辦理重核假釋或註銷假釋事宜。本案依裁定刑期按新舊法比率推算約須執行2年10月24日才符合假釋基本要件。

訴願認為，法務部的函示就顏清標所詢假釋及累進處遇法律適用疑義事項為說明，性質僅是單純的事實敘述及理由說明，非屬行政處分，顏清標提起訴願，於法不合，予以不受理。

台北高等行政法院認為顏清標對非屬行政處分的函文提起行政訴訟，起訴不備，駁回顏清標之訴。1020903
