囚信徒鞭打奪產 神棍判2年2月定讞

新北市三重「聖殿宮」有一名乩童，五年前覬覦信徒家產，竟然假借神明上身，逼迫信徒兩個兒子簽下同意書、把家產交給聖殿宮託管，還把兩人戴上手銬拘禁鞭打。最高法院依照「私行拘禁」等罪名，判處有期徒刑兩年兩個月定讞。　　（潘千詩報導）

判決書指出，三重「聖殿宮」的黃姓乩童，因覬覦土城黃姓大地主的家產，竟在民國98年元月間，趁黃姓地主在聖殿宮舉辦家族祭祖時假借神明「上能元帥」旨示，要地主的兩個兒子簽署「遺產分配同意書」，黃家人不從，雙方發生爭執，被害長子為掩護弟弟逃跑，長子因此遭囚禁3天，被逼簽下自己因帶槍被捕，自願留宮靜思改過的承諾書才獲釋。至於弟弟逃跑沒幾天，又被黃姓乩童派人抓回上銬，也被迫簽下「自願留在普願寺1至12年同意書」，更被酷刑「管束」了58天才獲釋。

一、二審認定，黃姓乩童假借宗教儀式，濫用私刑成傷，行徑囂張、手段惡劣，依照私刑拘禁、傷害等三罪，判處黃姓乩童有期徒刑兩年兩個月，案件上訴三審，最高法院駁回上訴，全案就此確定。
