健檢未發現罹癌 　1年後死亡求償敗訴

【劉志原╱台北報導】曾患肺結核的陳姓男子2009年12月到北市西園醫院進行全身健檢及胸部電腦斷層掃描無異狀，2個多月後久咳回診，也僅診斷出「逆流性食道炎」，後經防癆協會檢查再轉診台大醫院，竟發現罹患肺癌4期，隔年12月過世，家人怒向醫院求償550萬元，但北院認定醫院無疏失判免賠；仍可上訴。

判決指出，陳男接受電腦斷層檢查雖察覺胸部異常，但缺乏舊資料比對，無法判別是否有肺癌，且陳男4個月後由台大醫院另行斷層掃描，再與他在西園醫院斷層掃描結果比對，才知肺右上葉有變化，並透過正子攝影診斷出癌癌細胞已轉移，因此不能認定西園醫院有疏失。
