【劉昌松／台北報導】中國貴州女子劉茜取得丈夫同意，由丈夫收養與她和前夫所生兒子，但法院一直依兩岸人民關係條例規定，判決不准收養，今天大法官做出解釋，認為該條例第65條的相關規定違憲，劉茜得知後說：「正義也來得太遲了，我兒子因為陸委會專案，年底就要拿到身份證了，不過也好，希望姊妹們以後不會再遇到這種問題。」

劉茜10年前嫁來台灣後，得知和前夫所生兒子竟在家鄉流浪乞討維生，但因劉女現任丈夫已有子女，依兩岸人民關係條例規定，劉女丈夫不能再聲請收養中國籍配偶的子女，劉女絕望之餘聲請釋憲。

大法官會議認為，相關規定限制過當，違反《憲法》比例原則，為有助於台灣人民婚姻幸福、家庭和諧，昨做出釋字第712號解釋，宣告相關規定自今天起違憲失效。
