軍中凌虐定義修法 天堂路非屬凌虐

陸海空軍刑法的「凌虐」罪，將重新明確定義，未來若屬於國軍教育、訓練、勤務的範圍，如海軍陸戰隊兩棲偵搜大隊結訓周最後一關測驗，俗稱「天堂路」的考驗，雖酷似虐兵行為，但將排除「凌虐」罪的定義，也不違法。

行政院政務委員林政則最近審查陸海空軍刑法修正草案，特別針對軍中「凌虐」行為作出明確定義，行政院會24日將通過這項修正草案。

行政院表示，洪仲丘事件後，確已衝擊軍中的教育訓練，動輒可能被指「凌虐」而觸法；為此，國防部決定修陸海空軍刑法，增列第44條第3、4款的規定，進一步釐清「凌虐」定義，未來並由國防部以負面表列方式做規定。

修正草案規定，未來非屬國軍教育、訓練、勤務、作戰或其他軍事的必要，而使軍人受到凌辱、虐待，或非人道待遇的行為；均屬「凌虐」定義。
