「公職人員利益衝突迴避法」為避免配偶或家人充當門神、損害公務機關權益，一經查獲可處一到三倍罰鍰，相關規定是否違憲？司法院大法官會議今天做出「釋字第716號」解釋。大法官「書記處長」吳永宋宣告：「門神條款」合憲，但「罰鍰規定」違憲，限定在一年後失效。他說：

大法官認為，過去經常有公職人員家屬，利用公職人員充當門神，很容易取得公務機關的合約，造成公共利益損害，因此「利益衝突迴避法」特別明文禁止公職人員或關係人，和服務單位進行交易，否則將處以獲利一到三倍的罰鍰。這項法令曾經導致不少民代家屬，因為從事營造或旅行社業，被認定違法而處以罰鍰，金額最高達到五億元，當事人不服、聲請釋憲。
