國安密帳如何運用　李登輝根本不知情

【張欽／台北報導】特偵組前年認定前總統李登輝與國民黨前投管會主委劉泰英侵占國安密帳2億5000萬元，台北地院審理2年後，今天下午4時宣判李登輝無罪。
 
合議庭認為，總統只參酌國家安全會議決議，李登輝根本不會先知悉「奉天專案」基金的每一筆支出明細，且根據總統府前辦公室主任蘇志誠等人證述，證明李登輝只知道外交部要歸還國安局墊付款，並由當時國安局長殷宗文執行，無法證明李登輝知道外交部歸還「鞏案」款項後，國安局要如何使用。
 
此外，經手國安密帳、已獲判無罪定讞的國安局前會計長徐炳強也證述，案件曝光後，殷宗文、劉泰英與他到鴻禧山莊找李登輝，殷請求補辦公文應付國安局查帳，但遭李拒絕，徐自行草擬晉見報告書：「鞏案經費墊款來龍去脈，我(李登輝)都知道」內容，但報告書中沒有李的簽名，李也否認知情，因此無法證明李登輝事前與殷宗文、劉泰英謀議。
 
合議庭綜合相關證據後，認定沒有任何證據證明李登輝知悉鞏案款項如何使用，因此判李登輝無罪，以免冤抑。
