WeChat搖一搖　男送女「鳥照」不起訴

【黃哲民／新北報導】新北市22歲胡姓男子以手機通訊軟體WeChat的「搖一搖」功能，隨機搜尋到20幾歲曾姓女子帳號，竟直接傳送自拍露鳥照給曾女，被指涉最重可判2年的散布猥褻圖畫罪嫌。新北地檢署指胡男是以一對一通訊，未讓其他人觀覽，今將胡男不起訴。

胡男否認意圖約砲，辯稱基於好奇，想知道女方看到露鳥照的反應，「就送她一個禮物」，傳送照片後就感到後悔，但他沒把露鳥照傳送給別人，沒有散布意圖。

曾女氣憤彼此不認識，胡男竟傳不雅照騷擾，用WeChat嗆胡男：「我已收集好證據，會去請教法律意見提告！」曾女未出庭也拒和解。至於胡男涉性騷擾曾女部分，因不構成肢體碰觸，僅有最高10萬元行政罰鍰責任。

曾女看到胡男傳的露鳥照，氣憤提告。
